REFUND & CANCELLATION POLICY

This Refund & Cancellation Policy (the "Policy") explains how cancellations, credit restorations and cash refunds work for purchases made through https://magikaru.com, operated by Sumcloud Inc. ("Magikaru", "we", "us" or "our"). It forms part of our Terms of Use.
The checkout terms shown before you pay—including the product, price, currency, billing interval, renewal status and payment provider—are incorporated into this Policy. If they conflict with this general Policy, the checkout terms control unless applicable law gives you a greater right.
1. Products Covered
We may offer:
- Subscription plans — access to features and, where stated, periodic credits for a monthly, annual or other term. A plan may renew automatically or may be sold for a fixed term without renewal; checkout will say which.
- Credit packs — one-time purchases of virtual credits used for eligible generation or other Service features.
These are digital products generally delivered to your account promptly after payment confirmation. Credits are not money, stored value or property and cannot be redeemed for cash except where law requires.
2. Pricing, Currency and Billing
- The price, currency, billing interval and applicable taxes are shown before purchase. Your bank or payment provider may charge separate conversion or processing fees that we do not control.
- Payments are handled by third-party payment processors or merchants of record. We generally do not store full payment-card details.
- For an auto-renewing subscription, you authorize recurring charges at the disclosed interval until cancellation. If the renewal price changes, we will provide any notice required by law before the new price applies.
- The name on your payment statement may be ours or that of the applicable payment provider or merchant of record.
Where permitted by law, checkout may ask you to consent to immediate delivery of digital content and acknowledge how immediate performance affects any statutory cancellation right.
3. Subscription Cancellation
- You may cancel an auto-renewing subscription using any cancellation control made available in the Service or payment-provider portal, or by emailing info@sumcloud.com. Submit the request early enough for us or the provider to receive and process it before the next renewal time.
- Cancellation stops future renewals. Unless the cancellation screen or checkout terms say otherwise, your paid feature access continues until the end of the current billing period. Credit validity and expiration follow the plan terms shown at purchase.
- A fixed-term, non-renewing plan expires automatically and does not need to be cancelled.
- Cancellation does not automatically refund the current billing period. Section 5 determines whether that charge is refundable.
4. Failed Tasks and Credit Restorations
A credit restoration is different from a cash refund.
- If a generation task fails before delivering a usable result because of a verified Service or upstream-provider failure, the Service may automatically return the applicable credits to your balance.
- A successful task generally consumes the displayed credits even if the Output does not match your subjective preference, because AI results are inherently variable.
- If credits were not restored after a verified technical failure, contact info@sumcloud.com with the task or transaction reference. We will review the task record.
- Restored credits do not create a right to receive the equivalent amount in cash.
5. Cash Refund Eligibility
5.1 New Subscriptions
You may request a full refund of the first charge for a new subscription within 7 calendar days after the charge if you have not materially used the paid benefits. In assessing use, we may consider credits consumed, completed generation tasks, paid-only features used, collaboration activity and storage consumed during that period.
If applicable law gives you a longer mandatory cooling-off period or a right that cannot be waived, that law controls.
5.2 Renewal Charges
Renewal charges are generally non-refundable because cancellation was available before renewal. If you believe a renewal occurred after a timely cancellation, was caused by a technical error, or could not reasonably be cancelled, contact us within 7 calendar days after the charge and we will review the records in good faith.
5.3 Credit Packs
- An unused credit pack may be refunded within 7 calendar days after purchase only if none of the credits from that pack have been consumed, transferred or otherwise used.
- Once any credits from a pack have been used, the pack is generally non-refundable because part of the digital service has been delivered.
5.4 Errors, Unauthorized Charges and Service Failure
Regardless of the periods above, we will provide the remedy required by applicable law and will review requests where:
- you were charged twice, charged in error or charged an incorrect amount;
- an auto-renewal was processed after a timely, effective cancellation;
- a charge was unauthorized, subject to reasonable account and payment verification; or
- a material paid feature was unavailable for an extended period because of a verified failure on our side and we could not provide a reasonable replacement or extension.
Depending on the circumstances, the remedy may be a full or partial refund, service credit, extension or other legally sufficient remedy.
5.5 Generally Non-Refundable Circumstances
Except where law requires otherwise, refunds are not generally available for:
- credits, subscription benefits or digital services already used or consumed;
- a change of mind after the applicable request period;
- dissatisfaction with an AI Output that was successfully delivered and materially conformed to the requested task, because results are inherently variable;
- inability to use the Service caused by your device, connection, incompatible third-party software or violation of our Terms;
- accounts suspended or terminated for a material breach of our Terms; or
- bank conversion charges, network fees or other third-party fees we did not receive.
6. How to Request a Refund
Email info@sumcloud.com from the address associated with your account and include:
- your account email;
- the charge date and amount;
- the order, invoice, task or transaction reference, if available;
- the payment provider used; and
- a concise explanation of the request.
Do not send us a full card number, password, private key or other sensitive credential. We may request additional information reasonably necessary to verify account ownership, the transaction or an authorized-charge claim.
We aim to acknowledge a complete request within 2 business days and resolve it within 7 business days. Complex provider, fraud or chargeback reviews may take longer; these targets do not replace a shorter deadline required by law.
7. How Approved Refunds Are Issued
- Refunds are normally returned to the original payment method. We cannot send a refund to an unrelated card, wallet or account.
- After approval and submission, a refund typically appears within 5–10 business days, but timing is controlled by the payment provider, bank, card network or blockchain and may take longer.
- Refunds are issued in the original transaction currency. Currency-conversion differences and third-party fees may not be recoverable.
- A refund may exclude a non-refundable third-party fee only if that exclusion was disclosed and applicable law allows it.
- When a charge is refunded, we may remove the corresponding credits, plan access and other benefits. If some benefits cannot be returned, we may issue a proportional refund where permitted.
8. Trials, Promotions and Plan Changes
- Trial length, conversion date and any required payment method will be disclosed when a trial is offered. Cancel before the disclosed deadline to avoid a charge.
- Promotional and discounted purchases follow this Policy unless the offer clearly states different lawful terms.
- Upgrades, downgrades and plan changes may take effect immediately or at the next billing period as shown before confirmation. Any proration will be shown or handled by the payment provider.
9. Chargebacks and Payment Disputes
If you believe a charge is wrong, contact info@sumcloud.com first when practicable so we can investigate promptly. This does not waive your right to contact your bank or payment provider.
If a chargeback is filed, we may provide the provider with relevant transaction, delivery, usage and communication records. We may temporarily restrict the related account while a dispute is investigated and may recover benefits tied to a reversed charge. Fraudulent or duplicate disputes may result in suspension or termination, but we will not retaliate against a good-faith exercise of a legal payment right.
10. Governing Terms and Consumer Rights
This Policy is governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules. The dispute-resolution provisions in Section 17 of our Terms of Use apply.
Nothing in this Policy limits a non-waivable right under the consumer law that applies where you live. Where this Policy, checkout terms and mandatory law differ, the rule most protective of your mandatory right controls.
11. Changes to This Policy
We may update this Policy prospectively. We will post the revised version and update the "Last updated" date. The policy and checkout terms in effect when you purchased generally govern that purchase, unless a later version is more favorable to you or applicable law requires otherwise.
